FMSD’s HR Team is here to guide you through the leave request process. At some point, most employees will need to be away from work for an extended period, whether due to personal or family health needs, the birth or adoption of a child, military service, bereavement, jury duty, or other qualifying reasons.
If you believe you may need to request a leave of absence, please email your assigned HR Technician. An HR Technician will schedule a meeting with you to review your eligibility and assist you with applying for and scheduling the leave that best fits your situation.
What is "Leave"?
"Leave" is an arrangement between you and FMSD for an extended absence or reduction of work hours. It differs from Vacation and Sick Leave, which are both forms of compensated time off for occasional short-term absences from work.
Who is eligible for Leave?
Eligibility for longer-term leave for FMSD employees is limited to specific circumstances. These circumstances are defined both by the relevant laws under which employees have leave rights such as federal and state family and medical leave statutes and by the provisions outlined in the collective bargaining agreements. Together, the laws and agreements establish who qualifies for extended leave, the allowable duration, and the procedures for requesting it.
The FEDERAL Family Medical Leave Act (FMLA)
Under the Family Medical Leave Act (FMLA), if you have more than 12 months of service with FMSD and have worked at least 1,250 hours in the 12 month period before the date you want to begin your unpaid, job-protected leave for specified family and medical reasons such as;
- Employee’s own illness
- Illness of a spouse, parent or child
- Pregnancy Disability Leave and recovery from birth
- Military Leave
The California Family Rights Act (CFRA)
Under the California Family Rights Act (CFRA) if you have more than 12 months of service with FMSD before the date you want to begin your leave, you may have a right to take unpaid, job-protected leave (CFRA leave). This leave may be up to 12 workweeks in a 12-month period for the birth, adoption, or foster care placement of your child. CFRA also protects your right to care for a sibling, grandparent, grandchild and parent in laws with serious health conditions.
